1. General

1.1 These general terms and conditions apply to all agreements between NARRATIEF and its customers regarding the sale and delivery of marketing services. By using our services or by entering into an agreement, you agree to these terms and conditions. If you have any questions, you can contact us via the details on our website.

1.2 These terms and conditions apply exclusively to companies. In the event of conflict with the customer's terms and conditions, the terms and conditions of NARRATIEF shall prevail, unless otherwise agreed in writing. We reserve the right to change these terms and conditions at any time. Changes will be communicated via our website or by e-mail. By continuing to use our services after a change, you accept the changed terms and conditions.

2. Definitions

  • Narrative: The trade name of the company, established in Pepingen.

  • Customer: Any natural person or legal entity that enters into an agreement with NARRATIEF for the purchase of marketing services.

  • Agreement: The agreement between NARRATIEF and the Client regarding the provision of marketing services, as set out in a written quotation or contract.

  • Marketing Services: All services offered by NARRATIEF, such as search engine optimization (SEO), search engine advertising (SEA), content creation, social media management, email marketing, marketing consulting, branding, web design, and other online and offline marketing activities.

  • Quotation: A written statement from NARRATIEF containing an overview of the services offered and the associated prices. The quotation serves as an invitation to enter into an agreement and has a validity period as stated in the quotation itself.

  • Project: A specific set of services that NARRATIEF performs for the Client within a specified time period and according to agreed objectives.

  • Delivery period: The agreed period within which the services will be provided by NARRATIEF, as set out in the quotation or agreement.

  • Content: All text, images, videos, graphic designs and other materials created by NARRATIEF that are part of the Marketing Services and are intended for publication or promotion.

  • Intellectual Property Rights: All intellectual property rights relating to the content and marketing strategies provided by NARRATIEF, including copyrights, trademark rights, trade name rights, and database rights.

  • Payment term: The term within which the payment must be made by the Customer, as stated in the quotation or the agreement.

  • Right of withdrawal: The right of the Customer to cancel the agreement within a certain period without giving any reason, if applicable according to the applicable law and depending on the nature of the service.

  • Feedback Period: The agreed period during which the Client must provide comments and approval on draft work, such as content or design, before the project moves to the next phase.

3. Services

3.1 NARRATIEF provides marketing services such as SEO, SEA, content creation and strategic advice. We offer customized solutions that meet the specific needs of our customers and adapt our offering based on market developments.

3.2 Our services are provided as described on our website or in the quotation. Any inaccuracies or shortcomings must be reported within 14 days of delivery, so that we can remedy this. We strive for high customer satisfaction and continuously improve our services based on feedback.

4. Prices and payment

4.1 All prices in quotations or on our website are in euros and include VAT, unless otherwise stated. Any additional costs are clearly stated.

4.2 Payment must be made via the offered payment methods, such as bank transfer or online payment systems. After receipt of payment, the execution of the services will start according to the agreed schedule.

 

4.3 In case of delay in payment we reserve the right to suspend the delivery of services. In case of problems with payment we will contact you to find a solution.

5. Delivery and risk

5.1 For physical products delivered as part of our services (such as printed matter, promotional materials or other marketing materials), delivery will be to the address provided by the customer. Digital services and content, such as campaigns, strategies and designs, will be made available via email, a secure online platform or other agreed digital channels once payment has been received.

5.2 The risk of loss or damage of physical products passes to the customer at the time of delivery. We recommend that all deliveries are checked for any damage or deviations immediately upon receipt. Any deficiencies or damage must be reported to us within 48 hours of receipt. Digital content is considered delivered at the time the customer has access to the content via the agreed digital channels.

5.3 NARRATIEF strives for the timely delivery of all products and services according to the agreed terms in the agreement or quotation. In the event of a delay, NARRATIEF will inform the customer as soon as possible and enter into consultation to find a suitable solution.

6. Cancellation Policy

6.1 Agreements for services may be cancelled under certain conditions and in consultation. Cancellation must be made in writing and may incur costs, depending on the stage of the service provision. In the event of cancellation of a service after work has commenced, costs already incurred and hours worked will be charged. If a project is cancelled within a period of less than 7 days before commencement, NARRATIEF reserves the right to charge up to 50% of the agreed total price, unless otherwise agreed.

6.2 For digital services and content that are made immediately available or personalized for the customer (such as customized strategies, campaigns or designs), no right of return or refund is possible after delivery, unless the service does not meet the specifications as set out in the agreement. If a digital service or content does not meet the expectations as described in the agreement, NARRATIEF will consult with the customer to provide a solution, for example by means of adjustments or additional corrections.

6.3 In the case of physical products, these can be returned within 14 days after receipt, provided that they are unused, undamaged and in their original condition, unless these products are specially made to measure for the customer. Return costs are for the account of the customer, unless the product is defective or incorrectly delivered.

7. Liability

Generally speaking, a Privacy Policy often addresses these types of issues: the types of information the website is collecting and the manner in which it collects the data; an explanation about why is the website collecting these types of information; what are the website's practices on sharing the information with third parties; ways in which your visitors and customers can exercise their rights according to the relevant privacy legislation; the specific practices regarding minors' data collection; and much much more.

8. Privacy

8.1 NARRATIEF respects your privacy and acts in accordance with the applicable privacy legislation. Personal data is used exclusively for the execution of our services and is not shared without permission, unless required by law.

9. Applicable law and disputes

9.1 All agreements, services and disputes between NARRATIEF and the Customer are exclusively governed by Belgian law. This means that all transactions, interpretations of the agreement and any disputes are subject to Belgian law. The choice of Belgian law offers clarity and legal certainty for both parties.

9.2 Disputes arising from or related to the agreement, or the execution thereof, will preferably be resolved by mutual consultation and mediation. NARRATIEF strives for a constructive and quick solution in consultation with the Customer, whereby both parties can discuss their positions and possible solutions.

9.3 If an amicable solution proves impossible, the dispute will be submitted to the competent court in the judicial district where NARRATIEF is established, unless mandatory statutory provisions prescribe otherwise. This also includes disputes about the interpretation, validity, execution or termination of the agreement.

9.4 Both parties undertake to make reasonable efforts in the event of a dispute to reach a solution that is acceptable to both parties. If one of the parties, when entering into the agreement, unilaterally requests a change in the applicable court or applicable law, this will be agreed in writing and separately.

9.5 NARRATIEF reserves the right, if necessary and desirable, to engage an external mediator or legal advisor to resolve the dispute in an efficient manner, provided that the costs of such mediation or advice are shared fairly between the parties, unless otherwise agreed or provided by law.

10. Changes to the general terms and conditions

10.1 NARRATIEF reserves the right to change these terms and conditions. Changes may be necessary to comply with new laws and regulations, to improve our services or for operational reasons. We recommend that you regularly consult the general terms and conditions to stay informed of any changes.

10.2 Changes will enter into force at the announced effective date. If no specific date has been communicated, changes will enter into force for the customer as soon as the change has been communicated. It is the customer's responsibility to keep up to date with the most recent version of the general terms and conditions.
